General website, ordering and service terms for The Water Cart.
"Company" means The Water Cart (Pty) Ltd. "Customer" means any person or entity placing an order with the Company. "Products" means Cape Aqua water and related products sold by the Company. "Website" means thewatercart.co.za and associated pages.
By placing an order with the Company via WhatsApp, telephone, email, website or social media, you agree to be bound by these Terms and Conditions. If you do not agree, you must not place an order.
Payment may be accepted via Electronic Funds Transfer (EFT) or cash on delivery, subject to operational arrangements. EFT payments must reflect prior to or at the time of delivery unless credit terms have been approved in writing.
Delivery is available to designated areas within Cape Town and surrounding areas approved by the Company. Delivery times are estimates only and may be affected by traffic, weather, power outages, supplier delays or other events beyond our control. Risk in the products passes to the Customer upon delivery.
Nothing in these Terms limits your rights under the Consumer Protection Act 68 of 2008. Customers are entitled to fair dealing and to receive products that are of good quality and reasonably fit for purpose, subject to our Returns & Refunds Policy.
Electronic orders placed via WhatsApp, email or our website may constitute binding transactions once confirmed by the Company. Our company details are as follows:

To the fullest extent permitted by South African law, The Water Cart will not be liable for indirect or consequential loss arising from use of the website or products. Our total liability in relation to a claim will not exceed the value of the order giving rise to the claim.
All content on this website, including trademarks, logos, text, graphics and imagery, is owned by The Water Cart or its licensors and may not be copied or used without permission.
These Terms are governed by the laws of the Republic of South Africa. If a dispute arises, the parties should first try to resolve it directly. If unresolved, a complaint may be referred to the Consumer Goods and Services Ombud or the National Consumer Commission, where applicable.
